Ma l’Autorità vigilerà sull’effettiva efficacia delle misure che verranno adottate

Tik Tok adotterà misure per bloccare l’accesso agli utenti minori di 13 anni e valuterà l’utilizzo di sistemi di intelligenza artificiale per la verifica dell’età. Inoltre, lancerà una campagna informativa per sensibilizzare genitori e figli.

E’ quanto ha comunicato la piattaforma di video sharing  al Garante della protezione dei dati personali, dopo il provvedimento di blocco imposto nei giorni scorsi dall’Autorità.

L’Autorità si è, in ogni caso, riservata di verificare l’effettiva efficacia delle misure annunciate.

Blocco degli utenti

A partire dal 9 febbraio, dando attuazione alle richieste del Garante, Tik Tok bloccherà tutti gli utenti italiani e chiederà di indicare di nuovo la data di nascita prima di continuare ad utilizzare l’app. Una volta identificato un utente al di sotto dei 13 anni, il suo account verrà rimosso.

Per identificare con ragionevole certezza gli utenti sotto i 13 anni, successivamente a questa prima verifica, la società si è impegnata a valutare ulteriormente l’uso di sistemi di intelligenza artificiale. Poiché l'individuazione di tali soluzioni richiede un bilanciamento tra la necessità di accurate verifiche e il diritto alla protezione dei dati dei minori, la società si è impegnata ad avviare con l’Autorità privacy dell’Irlanda - Paese nel quale la piattaforma ha fissato il proprio stabilimento principale - una discussione sull’utilizzo dell’intelligenza artificiale a fini di “age verification”.

A seguito dell’intervento del Garante, dal 25 gennaio Tik Tok ha anticipato l’introduzione direttamente nell’app di un pulsante che permette agli utenti di segnalare rapidamente e facilmente altri utenti che sembrano avere meno di 13 anni. Tutto ciò sarà in aggiunta alle attuali misure esistenti. TikTok si è anche impegnata a duplicare il numero dei moderatori di lingua italiana dei contenuti presenti sulla piattaforma.

Più informazioni agli utenti

Dal 4 febbraio Tik Tok lancerà una campagna informativa sia sulla app che su altri canali. Sulla app, la società invierà notifiche push agli utenti prima di bloccarli, e li informerà sul requisito dell’inserimento dell’età.

Verranno pubblicati anche dei banner per fornire link con informazioni sugli strumenti di sicurezza e su come cambiare le impostazioni del profilo da “pubblico” a “privato”. Sul web e sulla carta stampata la campagna si rivolgerà specificamente ai genitori, ribadendo, tra l’altro, il limite di età per l’iscrizione alla piattaforma.

Informativa per i minori

Infine, a beneficio degli utenti minori, Tik Tok migliorerà il riassunto della propria Informativa Privacy sull’app per gli utenti minori di 18 anni, in modo tale da spiegare, in modo accessibile e coinvolgente, i tipi di dati che raccoglie e come essi vengono trattati.

Campagna di sensibilizzazione del Garante in collaborazione con Telefono azzurro

Allo scopo di rafforzare l’azione di tutela nei confronti dei più piccoli, il Garante per la privacy avvierà sulle tv nazionali, in collaborazione con Telefono Azzurro, una campagna di sensibilizzazione con l’obiettivo di richiamare i genitori a svolgere un ruolo attivo di vigilanza e a prestare particolare attenzione al momento in cui verrà richiesto ai figli di indicare la loro età per accedere a Tik Tok.

Tik Tok to comply with the requests by the Italian Garante
The Italian SA will monitor effectiveness of the measures put in place

TikTok will implement measures to ban access to users aged below 13 years and will consider deploying AI-based systems for age verification purposes. An information campaign will also be launched by the company to raise parents’ and children’s awareness.

This is the reply provided by the video sharing company to the Italian SA (Garante per la protezione dei dati personali) following the limitation of processing order the Garante had issued last week.

The Italian SA will in any case monitor the effectiveness of the measures to be enforced.

Users’ access to be blocked

Following the requests made by the Garante, TikTok will block access by all Italian users from 9 February and request the date of birth to be re-entered in order to continue using the app. If an user’s age is determined to be below 13 years, that user’s account will be removed.

In order to identify users below 13 years with reasonable certainty following this initial check, the company undertook to further consider the deployment of AI-based systems. Since the implementation of such systems requires balancing the need for accurate verification against the children’s right to data protection, the company committed to starting a dialogue with the Irish Data Protection Commission (DPC) on the use of AI for age verification purposes. Ireland is where TikTok set its main establishment in the EU.

Following the steps taken by the Garante, TikTok implemented an in-app button already from the 25th of January, to enable users to quickly and easily report other users that may seem to be below 13 years of age. All the above measures supplement those already in place. TikTok undertook to also double the number of Italian moderators of platform contents.

More information to users

An information campaign will be launched by TikTok starting on 4 February both via the app and through other channels. The company will send push alerts to users on the app before blocking their access and will inform them on the need to enter their age. Banners will also be published containing links to information on security tools and on how to change profile settings from ‘public’ to ‘private’. The information campaign both via the web and through the press will be addressed to parents and the age threshold for registration will be specifically highlighted, among other things.

Privacy notices for children

Finally, TikTok will improve the wording of its short privacy notice for users under 18 years so as to explain what data are collected and how those data are processed in an easily understandable and user-oriented manner.

Awareness-raising campaign by the Garante jointly with Telefono azzurro

The Italian Garante will launch an awareness-raising campaign on national TV channels, in cooperation with a child protection charity (Telefono Azzurro), to foster safeguards for children. The campaign is aimed at calling upon parents to actively supervise and pay special attention to the situations where their children are requested to enter their age in order to access TikTok.
